CHICHESTER BOARD OF ADJUSTMENT MINUTES
JANUARY 27, 2010

Case#227-James & Clarisse Kersch, Healthy Buffalo- Map 3 Lot 29-1 Appeal from an Administrative Decision of the Building Inspector for sign violation, removal of improvements.
Members Present:  Mark McIntosh, Chairman; Stephen MacCleery, ex-offico; Richard Millette; David Hartley; David Dobson; Tom Wainwright, Alternate.
Others:  James Kersch, Building Inspector John Dever, Selectman Richard DeBold, Walter Sanborn, Allen Mayville.

Mr. Kersch stated that he was appealing the decision of the Building Inspector because Mr. Dever says the sign falls out of the sign ordinance requirements.  What counts as the size of the sign?  He doesn’t feel the sign is outside of the ordinance but if it is, he could apply for a variance for additional signage.

David Dobson asked if a permit was obtained for the sign changes.

Mr. Kersch did make changes to his sign after it was hit by a car and sign needed to be reconstructed.  He didn’t know that he should have gotten another permit.  The current sign is 48.7 sq. ft. on one side without counting the buffalo on top.

Building Inspector John Dever stated that Mr. Kersch was given a permit by the former BI in Oct. 2008.  When he took over he went through all the permits and inspected the properties and issued completion forms for the sign.  Since then, Mr. Kersch’s sign has been taken down and a new structure was erected.  This current sign is a lot more than the original.  If he had come to the BI he would have been instructed to go to the Planning Board.

The BOA commented that there have been significant changes without a permit from the BI.

After this discussion, applicant decided to withdraw his application from the BOA and go to the Planning Board to discuss his additional signage.
